These Terms & Conditions (“Terms”) govern your access to and use of the website located at https://jvbuyshouses.com (the “Site”) operated by JV Buys Houses (“JV Buys Houses,” “we,” “us,” or “our”), and any communications between you and us that arise from your use of the Site. By accessing or using the Site, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Site.

1. Who we are

JV Buys Houses is a real estate investment business. We purchase residential real estate directly from property owners for our own account, and we may assign or resell our interest in a purchase agreement or a property to other buyers or investors. We are not a licensed real estate brokerage and do not act as your agent, broker, attorney, accountant, or fiduciary. Nothing on the Site constitutes legal, tax, financial, or investment advice. You should consult your own licensed professionals before making decisions about your property.

2. No offer or binding agreement

Information on the Site, including statements that we “buy houses,” make “cash offers,” or close on a particular timeline, is a general description of our business and not an offer to purchase any specific property. Submitting property information through the Site is a request for us to evaluate your property and contact you. It does not create a contract, obligate us to make an offer, or obligate you to sell.

Any offer we communicate to you, whether verbally, by text, by email, or otherwise, is non-binding and subject to change until both parties sign a written purchase agreement. Only a fully executed written purchase agreement creates binding obligations, and its terms will control over anything stated on the Site.

3. No guarantees

We make no guarantee regarding the amount of any offer, whether an offer will be made, the timing of any closing, the outcome of any transaction, or any financial result. Timelines described on the Site are typical examples and depend on many factors, including title, liens, occupancy, lender payoffs, and the schedules of third parties such as title and escrow companies.

4. Eligibility and accuracy of information

By submitting information, you represent that it is accurate and complete to the best of your knowledge, that you are the owner of the property or are authorized to act on the owner's behalf, and that you have the right to share the information you provide. • Upload or transmit malicious code or content that is unlawful, defamatory, harassing, or infringing; or
• Use the Site for any purpose other than its intended purpose of requesting information about selling real property.

We may suspend or block access to the Site for anyone who violates these Terms.

7. Intellectual property

The Site and its content, including text, graphics, logos, the JV Buys Houses name and mark, page design, and software, are owned by or licensed to JV Buys Houses and are protected by copyright, trademark, and other laws. You may view and print pages for your personal, non-commercial use in connection with considering a sale to us. 10. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, JV BUYS HOUSES AND ITS OWNERS, MEMBERS, EMPLOYEES, CONTRACTORS, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SITE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT WILL OUR TOTAL LIABILITY ARISING OUT OF OR RELATED TO THE SITE EXCEED ONE HUNDRED U.S. DOLLARS ($100). You agree to indemnify and hold harmless JV Buys Houses and its owners, employees, and agents from any claims, damages, losses, and expenses (including reasonable attorneys' fees) arising out of your violation of these Terms, your misuse of the Site, or information you submit that is inaccurate or that you were not authorized to provide.

12. Governing law and disputes

These Terms are governed by the laws of the State of California, without regard to its conflict-of-law rules. Any dispute arising out of these Terms or your use of the Site will be brought exclusively in the state or federal courts located in San Bernardino County, California, and you consent to their jurisdiction. Disputes arising under a signed purchase agreement are governed by that agreement.

13. Changes to the Site and these Terms

We may change, suspend, or discontinue any part of the Site at any time. We may also revise these Terms by posting an updated version with a new effective date. Your continued use of the Site after changes take effect constitutes acceptance of the revised Terms.

14. General

If any provision of these Terms is found unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver. These Terms, together with the Privacy Policy, are the entire agreement between you and us regarding use of the Site, and supersede any prior understandings regarding the Site. You may not assign these Terms; we may assign them in connection with a business transfer.
